He's misunderstanding the DRM world. DRM crap only applies to DRM'ed content. If we assume that "independent" content doesn't have DRM, then devices will always play it at full rez.
As for iTV's behavior with DRM'ed content, there is no way to say. There are published rules for device restrictions, but companies like Apple and MS have a history of negotiating them down to something more palatable (to them, not necessarily to us). So iTV's behavior depends on how good of a negotiator Jobs it. We're not privy to these back-room discussions, so we'll just have to wait until iTV comes out.
