I Blew It
I thought I'd gotten there plenty early to get a seat, but the line was amazingly long and I didn't get in.
I did spend some time <s>eavesdropping</s> schmoozing outside after the arguments, and the consensus seems to be that the Supremes are sympathetic to the plaintiff and are going to remand this to a lower court, to which counsel for the defense does not look forward.
I said a brief hello to Larry Lessig and asked how he thought it went. He was cautiously optimistic, but the young lawyers calling him "Boss" wanted to dunk him in the nearby fountain. (They didn't think to bring the Gatorade.)
Those who heard the arguments agreed the justices seemed convinced that some limited time was required for copyright duration. What this means in practice is anyone's guess--and the questions asked by the justices don't necessarily indicate how they plan to rule.
This case was a long shot going in, but I think it got a lot shorter today.
There are resources available to me while I'm in town, and I'll try to take advantage of them. If I get anything useful, I'll post it.
