The Barry problem is a manifestation of a larger one - the "it's my content and I'll block you if I want to" phenomenon. Some folks just don't like deep linking and want you knocking on the front door or not at all. There were a couple of cases pending in California last year involving eBay and Tickets.com that could have helped make some useful law (non-sequitor, ok), but I believe they've both settled. (More here.) I'll bet part of the Herald's strategy is to implement a pay-for-usage plan where if you're willing to shell out the bucks you can access their archives to your heart's content.
